It is commonly accepted that recourse to war is justifiable only as a last resort. If a situation can be resolved by less harmful means, then war is unjust. It is also commonly accepted that violent actions in war should be necessary and proportionate. Violent actions in war are unjust if the end towards which those actions are means can be achieved by less harmful means. In this article, I argue that satisfaction of the last resort criterion depends in part upon the likelihood of success of non-violent alternatives to war, and that the actual and potential effectiveness of non-violent resistance means that the last resort criterion of the jus ad bellum and the proportionality criterion of the jus in bello are harder to satisfy than is often presumed.  相似文献

According to just war theory, a resort to war is justified only if it satisfies the right intention condition. This article offers a critical examination of this condition, defending the thesis that, despite its venerable history as part of the just war tradition, it ought to be jettisoned. When properly understood, it turns out to be an unnecessary element of jus ad bellum, adding nothing essential to our assessments of the justice of armed conflict.  相似文献

The empirical international conflict literature has given much recent attention to interstate armed force’s impact on human well-being. While empirical research has advanced our understanding of the phenomenon considerably, we argue that one conclusion that many studies have reached is preliminary. Some recent research contends that only full-scale war, and not force short of war, has a discernable impact on human welfare or physical quality of life (PQOL). We develop theory on one type of force short of war, large-scale foreign military intervention (FMI), and its potential effects on PQOL. Using interrupted time series and panel corrected standard error methodologies, we find that from 1960 to 2005 large-scale FMI had a statistically and substantively significant impact on the PQOL of populations in 106 developing countries. The specific effect that this type of armed force has depended in large part on the regime type of the target country.  相似文献

ABSTRACT

I argue in this article that traditional just war theory did allow private, indeed even individual war, and that arguments in support of a legitimate authority criterion, let alone in support of the “priority” of this criterion, fail. I further argue that what motivates the insistence on “legitimate authority” is the assumption that doing away with this criterion will lead to chaos and anarchy. I demonstrate that the reasoning, if any, underlying this assumption is philosophically confused. The fact of the matter is that wars need not necessarily be authorized by some higher authority (such as a king, president, or parliament) in order to be justified, and this moral fact does not need to lead to chaos and anarchy. Accordingly, the criterion of legitimate authority cannot be relied on to delegitimate individual war, private war, guerrilla war, or even terrorism. Finally, I consider some other defenses of authorization and demonstrate that the “authorization” these accounts defend is either not needed for justification or already provided by other just war criteria or, indeed, entirely fictitious.  相似文献

On War’s unfinished state has been a source of difficulties for interpretation for 180 years. By establishing a hierarchy of revision among the parts, we propose a criterion that can bring any part of On War in line with the most advanced stage of Clausewitz’s thinking. We exemplify the utility, illustrate the underpinnings and appreciate the potential of this criterion. We argue that the criterion offers the prospect of a shared, coherent, fully consistent and faithful rendering of Clausewitz’s theory of war.  相似文献

This study presents a framework and models for the analysis of government budget allocation into defense and civilian expenditures in situations of uncertainty about the incidence of war. The models display the intricate relationships between security levels, subjective probabilities of the occurrence of war, and potential war damages. We show that poor countries tend to perceive greater probabilities of war than their richer rivals, and that the psychological burden of insecurity is larger when the country’s wealth is larger and when its preference for security is higher. We apply our models to the Israeli–Syrian arms race and show that the higher rate of growth of Israel’s gross domestic product relative to that of Syria is expected to lead to an increase in Syria’s perception of the likelihood of war and to a decrease in Israel’s perception of such a likelihood. We also show that if Syria’s regime becomes ideologically more extreme, the monetary cost of maintaining Israel’s security at the level that it enjoyed prior to the change will be very high, whereas the monetary cost of maintaining Israel’s welfare will be moderate.  相似文献

Though historians continue to argue about the role of American nuclear threats in producing an armistice in the Korean War, by 1953 the United States was moving closer to actually escalating the war with the employment of atomic bombs. While military studies and unsatisfactory exercises during the first two years of the conflict had relegated such weapons to a role just as a last resort to prevent a catastrophe, frustration with stalemated peace talks and the aggressiveness of General Mark Clark combined to produce a set of contingencies envisioning an expanded war involving nuclear air strikes.  相似文献

ABSTRACT

Though it is legally permissible to kill combatants in war, unless they are rendered hors de combat, the existence of “Naked Soldiers” raises an important moral question: should combatants kill vulnerable enemy combatants or show mercy towards them? Most philosophers who address this question argue that it is morally permissible to kill the Naked Soldier given the extended notion of self-defense during war. They ground their arguments in a form of collectivism. In this article, I use Larry May’s argument. He offers an approach that extends the principle of discrimination that would apply also to combatants. Instead of assuming all combatants are de facto dangerous, this approach would allow for nuance in targeting the enemy and showing mercy when enemy combatants clearly pose no danger, in other words, when they are Naked Soldiers. I defend this view against two criticisms: Noam Zohar’s view of armies as complex collectives and Stephen Deakin’s view that a policy that spares Naked Soldiers would be open to abuse. I argue that it is not only morally suspect to kill Naked Soldiers, but also it is within the spirit of both international laws governing war and the just war tradition to offer mercy whenever possible.  相似文献

In 2014, Colonel M. Shane Riza published an article in this journal arguing that remotely piloted aircraft (RPA) and robotic weapons threaten the US Air Force’s warrior ethos. Riza has clearly articulated the sentiments of one side of a vibrant debate within our service. This paper presents an alternative view; a view held by some who have experienced these new forms and tools of war, and who have wrestled with their implications first-hand. In this paper, we address some methodological concerns with Riza’s approach and then engage some misunderstandings about RPA’s relationship to military history and to risk. The second part of this paper takes a close look at some of the early Just War thinkers to determine what implications the tradition may have on the warrior ethos. We propose, as an alternative to Riza’s position, a return to an ethos grounded in humility, charity, and a conception of war as a last resort; in short, a return to the Just Warrior Ethos.  相似文献

Scholars and policymakers argue that violent actors – termed ‘spoilers’ – pose a significant threat to civil war peace agreements. Yet existing research, which is overly reliant on single-case studies, has not effectively determined how prevalent spoiling is, or thoroughly examined what its ultimate effects are on peace agreements. This article draws on a newly constructed cross-national dataset of spoiling following 241 civil war peace agreements in the post-Cold War era to analyze spoiling. It finds that spoiling intended to terminate an agreement is not as common as typically assumed, but still plagues a sizeable number of peace agreements. Moreover, most actors who resort to this strategy typically fail in their goals and the agreement is not at risk, despite the high publicity and attention given to these threats. Yet particular types of actors, most notably paramilitaries and state security forces excluded from the agreement, can pose a significant threat to peace.  相似文献

ABSTRACT

This article constitutes an attempt to demonstrate the complexity of factors affecting the legitimate acquisition and reasonable exercise by a political community of the right to war as specified in the just war criteria of jus ad bellum. To achieve this purpose, a brief analysis is presented of the intentional participation in World War I of thousands of Polish volunteers forming military units deployed by the Central Powers on the Austrian-Russian front. Considered in light of the standard principles of just war, the military enterprise of the Polish Legions, as they were called, turns out to be a paradoxical instance of warfare which, while being part of a state-to-state aggression, must be deemed compliant with all the principles in question. As a means of explaining this paradox, a modification of the concept of justified intervention is proposed, embracing military efforts aimed at the ultimate defeat of all the (unjustly) warring parties operating within a given territory. In consonance with the classic just war approach, it is also argued that the justification for such an intervention is essentially dependent on its being initiated by, or attributable to, an unquestionable state agent acting in defence of the state’s basic prerogatives.  相似文献

If a declining state has incentives for preventive war, the rising state should have incentives to delay a confrontation until it is stronger. We develop the theoretical paradox and examine the July 1914 crisis. Why did Russia, rising relative to Germany, not adopt a buying-time strategy? We argue that although most Russian leaders hoped to avoid a confrontation, they feared that the failure to support Serbia would lead to a loss of Russian credibility and a significant setback to Russia’s position in the Balkans, one that could not easily be reversed, even with Russia’s expected increase in relative military power.  相似文献

The legal equality of combatants (LEC) is a fixture of international law and just war theory. Both scholars who embrace and those who reject the moral equality of combatants seem committed to the legal equality of combatants. Their reasons usually include pragmatic worries about unjust combatants committing even more harm if they were to be simply prohibited from fighting. In this article I argue that this sweeping commitment to the legal equality of combatants is mistaken and that it is often grounded in a misunderstanding of the way international law governs behavior.  相似文献

The surge in threats aided by or carried out through cyberspace has placed significant pressure on the intelligence community to adapt or leave itself open to attack. Indeed, many in both political and intelligence circles argue for access to ever greater amounts of cyber information in order to catch potential threats before they become real. By collecting all our digital information, the intelligence community argues that it is not only able to detail what people have done or are currently doing but also predict what their next move might be. However, the ethical implications are unclear and the backlash following Edward Snowden’s revelations have shown that such activities are not without controversy. This leaves the debate stuck between the important, ethical role that intelligence can play and the potential for its unrestrained use to cause undue harm. This paper will resolve this by giving greater detail to cyber-intelligence practices, highlighting the different levels of harm that the various intelligence operations can cause. The essence of this paper is not that cyber-intelligence should be banned outright, but that it can be justified given the necessary circumstances. Therefore, the paper will develop a specialised set of Just Cyber-Intelligence Principles, built on the just war tradition, to outline if and when such activities are justified.  相似文献

Ethnicity and ideology are frequently used to determine whether an armed group is hostile or friendly vis-à-vis the state. By contrast, I argue that the social structure of insurgent movements holds more explanatory power for their respective positions than ethnicity or ideology. To illustrate this, I apply Pierre Bourdieu’s concept of a contest between forces of ‘conservation’ and forces of ‘heresy’ to the current Afghanistan war. I demonstrate that the social structure of the Taleban renders them prone to ‘heresy’, while the formerly second biggest insurgent group, Gulbuddin Hekmatyar’s party, has rather been an impeded force of ‘conservation.’  相似文献

In this paper I argue that a remotely piloted aircraft (RPA) pilot’s act of killing remotely, when it is done in the defense of another person, can be viewed as an act of sacrifice. This argument concludes from two premises. First, the RPA pilot faces psychological risk to self by carrying out such an action; second, the RPA pilot is motivated to some significant degree by something other than self-interest. Moreover, I challenge both the view that RPA represent merely an incremental development in technology yielding an incremental expansion of the distance between the war-fighter and the target and the view that RPA is revolutionary in some fundamental sense. I instead argue that, based upon the natural geometric boundary imposed by the earth’s shape, RPA have maximized the physical distance between the war-fighter and the target and, over time, this fact will change, not only the psychological effects on the RPA pilot, but also the way we view killing and distance in general. When taken together, these two broad claims, that other-defense can justify killing in war and that there is a psychological cost paid by remote killers, yield a conception of remote killing as an act of sacrifice that will inform the broader conversation about ethics, risk, killing, and RPA.  相似文献

This article examines how scholars of the just war tradition think about the ethical dilemmas that arise in the endgame phase of modern warfare. In particular, it focuses upon their reticence to engage the idiom of ‘victory’. Why, it asks, have scholars been so reluctant to talk about what it means to ‘win’ a just war? It contends that, while just war scholars may have good reason to be sceptical about ‘victory’, engaging it would grant them a more direct view of the critical potentialities, but also the limitations, of just war reasoning.  相似文献

American policy-makers are predisposed towards the idea of a necessary war of survival, fought with little room for choice. This reflects a dominant memory of World War II that teaches Americans that they live in a dangerously small world that imposes conflict. Critics argue that the ‘choice versus necessity’ schema is ahistorical and mischievous. This article offers supporting fire to those critiques. America's war against the Axis (1941–45) is a crucial case through which to test the ‘small world’ view. Arguments for war in 1941 pose overblown scenarios of the rise of a Eurasian super-threat. In 1941 conflict was discretionary and not strictly necessary in the interests of national security. The argument for intervention is a closer call that often assumed. Military officers often oppose political interference in the conduct of war. Political leaders respond by citing Clausewitz’s contention that “war is the continuation of politics with the addition of other means.” Scholarship in security studies and civil-military relations argues that civilians are right to oppose military autonomy because it serves the parochial interests of the military. However, through the dialectical relationship between the violent essence of war and its political nature, Clausewitz provides an alternative explanation for military demands for autonomy. He shows that military and political leaders are prone to an incomplete understanding of war that can undermine strategy and policy.  相似文献

Biological and chemical weapons are increasingly in the news. A series of events in the United States, beginning with the 11 September 2001 attacks and including mailed letters deliberately infected with anthrax later that year, have led to heightened fears of increasing resort to such agents for terror. Concurrently, the 2003 Iraq war, which failed to find weapons of mass destruction (WMD), has led to a great deal of cynicism about such threats, especially in the developing world. This article sets out the concerns of the International Committee of the Red Cross (ICRC) about the risks of new advances in the life sciences being turned to hostile use and explains what it is doing to try to encourage objective risk assessment and reduction in that context. We argue that, setting aside the rhetoric of the ‘war on terror’, there are sound reasons for actors in the life sciences in Africa to treat concerns about poisoning and the deliberate spread of disease seriously. It is in their interests to take practical action in line with their existing ethical and legal obligations in order to assess and reduce these threats.  相似文献
