| 摘 要： | 不确定的法律概念是法律中无法避免的客观事实,其生成不仅是由于语言本身的模糊性、多义性和不可定义性,也是语言本身的高度抽象性所致,更因为是立法者对于所要规范的事项无法完全预见,为了涵盖更广的规范对象,为了适应社会的变迁,而特意使用的相对模糊的概念形式。

| Abstract: | The imprecise legal concept is a legal phenomenon that cannot be avoided. More than the language’s fuzziness, the polysemy, un-definition, and highly abstract, it results from the legislator’s incapability to completely foresee the things he wants to normalize, to cover a broader standard object and to adapt society’s vicissitude, or for the sake of the conflict of authority and the compromise and uses the relatively imprecise form of concept intentionally. |
