人民警察危难救助探析

危难救助作为人民警察的法定义务,在保护公民、法人和其他组织的人身安全和财产安全方面发挥着至关重要的作用。在人民警察履行危难救助义务的实际过程中,存在着危难救助性质不明确、主体不清晰、条件不明确、救济制度不完善和法律责任模糊等突出问题,不利于人民警察合法、合理地履行职责和义务,严重制约和影响了危难救助的实际效果。对人民警察危难救助的界定、主体、条件、救济制度和法律责任等问题进行探析,以期对完善人民警察危难救助制度提供借鉴。

An Analysis of the Distress Rescue of the Police

Distress rescue is the legal obligation of the police,and it plays a vital role in protecting personal security and property of citizens,statutory persons and other organizations. However,in the actual process,when the police fulfill their obligations,there are many problems with the definition,scope,conditions,relief system and unclear le- gal liability of distress rescue,which are not conducive to the statutory performance of the police. If it is not paid much attention,the result and effect of the distress rescue will be adversely restricted. In this paper,the definition, scope,conditions,relief system and legal liability of distress rescue are theoretically analyzed. Hopefully,it can provide some useful references for the improvement of the police distress rescue system.
