| 摘 要： | 公安消防人员在灭火救援中是否享有紧急避险的权利,在司法实践中存有异议。通过对灭火救援中紧急避险的法律依据、构成要件、法律后果等几个方面的论述,阐明了公安消防人员在灭火救援中适用紧急避险的可能与价值,并对灭火救援中紧急避险进行了理论探析和展望。
