| 摘 要： | 作为证据制度,行政程序证据制度与诉讼证据制度有共性,可以借鉴诉讼证据制度的合理内容。但行政管理的特殊性与行政行为的多样性决定了行政机关不应照搬繁琐而严格的诉讼证据制度。主要采用比较的方法对行政程序证据制度的特点及功能进行分析和探讨,表明行政程序证据制度是一类独立的证据制度。

| Abstract: | The evidence system of administrative procedures and litigation evidence system have something in common,which provide references for the reasonable content of litigation evidence system.But the administrative organ should not copy the complicated and strict litigation evidence system because of the specificity of administration and the diversity of administrative acts.In this paper,the characteristics and functions of the evidence system of administrative procedures are analyzed and discussed by using comparative method,which shows that the evidence system of administrative procedures is a kind of independent evidence system. |
