境外行政主体制度研究

行政主体理论自行政法成为公法重要组成部分时便成为行政法几个核心理论之一。自《中华人民共和国行政诉讼法》实施以来,行政主体理论研究成为我国行政法理论研究的重点之一。我国关于行政主体的内涵及外延,学术界各抒己见,至今缺乏统一的论断。境外一些行政法理论发达国家和地区的行政主体制度对于我们具有借鉴意义。     

Constructive Ambiguity and the Peace Process in Northern Ireland

The Belfast Agreement of 1998 was hailed at the time as a breakthrough in conflict resolution both in Northern Ireland and as a model for international emulation. In fact it has turned out to be neither; rather it has been a sad exercise in surrendering to terrorism and the cause of increased sectarian segregation and enmity. The core of the problem lies in the 'constructive ambiguity' at the heart of the Agreement - that is, a form of words that all could sign up to because each party could interpret them differently. This may have enabled everyone to sign up, but also implied they were signing up to different things and therefore were not in agreement. Consequently clever word games and spin by politicians and senior civil servants have created an, in some ways, worse situation, largely because real, substantive issues were ducked. This in turn has its roots in postmodernism, whose baleful influence can be seen throughout not only the Agreement but most government policy over the past 20 odd years.     

Two‐agent scheduling on a single sequential and compatible batching machine

We study two‐agent scheduling on a single sequential and compatible batching machine in which jobs in each batch are processed sequentially and compatibility means that jobs of distinct agents can be processed in a common batch. A fixed setup time is required before each batch is started. Each agent seeks to optimize some scheduling criterion that depends on the completion times of its own jobs only. We consider several scheduling problems arising from different combinations of some regular scheduling criteria, including the maximum cost (embracing lateness and makespan as its special cases), the total completion time, and the (weighted) number of tardy jobs. Our goal is to find an optimal schedule that minimizes the objective value of one agent, subject to an upper bound on the objective value of the other agent. For each problem under consideration, we provide either a polynomial‐time or a pseudo‐polynomial‐time algorithm to solve it. We also devise a fully polynomial‐time approximation scheme when both agents’ scheduling criteria are the weighted number of tardy jobs.     

Majority rule,minority issues: The Macedonian question in the Dekemvriana

This article examines the role of the Macedonian Question in the 1944 December Uprising (Dekemvriana) in Greece. While the Dekemvriana is commonly portrayed in right–left terminology in the historiography, this article argues that part of the reason for the left’s failure was their inability to manage the Macedonian ethnic component of the struggle, either within their armed forces or in their relationship with Yugoslavia. As such, this article integrates the early phases of the Greek Civil War into the broader literature on minorities in civil conflict, while simultaneously exposing some of the myths about Macedonian involvement that result from its contemporary political ramifications.
