"法条竞合"在我国刑事立法中普遍存在,其理论比较复杂.法条竞合的概念与种类、法律性质以及法条竞合的适用原则等问题,目前在我国刑法理论界尚无统一定论.理论上对这些问题进行深入研究、探讨,有助于在司法实践中准确选择适用法条.     

Epidemics,national security,and US immigration policy

What are relationships between epidemics, national security, and US immigration policy? This question is important because it sheds light on transnational or nontraditional security areas, American immigration policy, and a pressing issue for US leaders who have recently faced epidemics such as the West Africa Ebola outbreak that began in 2013. This article answers it and lays ground in the area by reviewing epidemics in world history, using International Relations and Security Studies works to specify dangers of contagions for states, and identifying three general immigration measures that American leaders have utilized from the seventeenth century to the present day to protect against contagions, which are (1) policies restricting entrance of foreigners thought to carry specified diseases, (2) the isolation or quarantining of immigrants with contagious disease, and (3) delegating the President with authority to stop immigration in the event of an epidemic abroad. This study has implications for research and contemporary US immigration policy.     

一种结合弹道规律的模糊交互式多模型算法

针对交互式多模型算法中转移概率矩阵与实际运动不匹配而影响跟踪精度的问题,通过分析某型导弹的典型弹道,将弹道规律融合到模型概率转移矩阵中,然后将转移概率模糊化处理,提出了一种基于弹道规律的模糊交互式多模型算法,然后以导弹蛇形运动转至比例导引的机动过程为例进行了仿真验证,比较了典型交互式多模型算法和模糊交互式多模型算法的跟踪性能。仿真结果表明:该算法可显著提高导弹机动段的跟踪精度。     

Soldiers as victims: behind military barracks in the post-colonial African army

This paper examines the ways in which the military infringes on the social and political rights of soldiers who joined the Zimbabwe National Army in post-independence Zimbabwe. Contrary to the scholarly and policy debates that present Zimbabwean soldiers as the silent prop behind President Robert Mugabe and the perpetrators of political violence, this paper argues that these soldiers have also been victimised in army barracks. The victimhood of soldiers has been explicit in the ways in which they are forced to execute their duties beyond their professional expectations. In substantiating this argument, the paper explores the unethical military training and the ways in which soldiers are disciplined and punished through Chapter 11:02 of the draconian Defence Act. The paper’s contribution stems from a ‘rights’ perspective that emphasises the right to freedom, justice and protection, which is usually quite silent in the military. But the question is how can soldiers’ concerns be translated into new practices without compromising so-called ‘state security’?     

滑模控制的新型双幂次组合函数趋近律

提出一种基于双幂次组合函数趋近律的新型滑模控制方案。与现有的快速幂次或双幂次趋近律相比,具有更快的收敛速度,同时还保持了全局固定时间收敛特性,收敛时间上界与滑模初值无关。当系统存在有界扰动时,能够使滑模变量在有限时间内收敛到稳态误差界内,同时其稳态误差要小于现有方法的。仿真实验验证了该方法的有效性及理论分析的正确性。     

Peace enforcement in Africa: Doctrinal distinctions between the African Union and United Nations

When the United Nations (UN) Security Council needs to authorize a peace enforcement operation in Africa, its partner of choice is the African Union (AU). Africa has developed significant peace operations capacity over the past decade. In addition to deploying eight AU operations, Africa now contributes 50% of all UN peacekeepers. African stability operations, like its mission in Somalia, are often described as peace enforcement operations. In this article, I question whether it is accurate to categorize African stability operations as peace enforcement? I answer the question by considering what the criteria are that are used to differentiate between peace enforcement and peacekeeping operations in the UN context. I then use the peace enforcement criteria to assess whether AU stabilization operations would qualify as peace enforcement operations. In conclusion, I consider the implications of the findings for the strategic partnership between the AU and the UN.     

New directions for African security

African security, particularly conflict-related political violence, is a key concern in international relations. This forum seeks to advance existing research agendas by addressing four key themes: domestic politics and peacekeeping; security sector reform programs; peace enforcement; and the protection of civilians. Each of the articles in this forum makes a case for analyzing African agency when it comes to African security. As a way of introduction, this short article sets out the main debates and concludes by providing further directions for future research.     

可调喷油规律下柴油机性能随喷油提前角的影响

为获取可调喷油规律条件下,喷油提前角对柴油机性能的影响规律及成因机理。在实现可调喷油规律喷射的基础上,基于Fire软件建立了柴油机工作过程计算模型,并通过试验对模型中的主要参数进行了标定,进而利用模型分析了靴形喷油规律下柴油机性能随喷油提前角的变化。结果表明：随着增压时刻的滞后,喷油规律由矩形过渡到斜坡形再到靴形,实现了灵活可调的喷油规律。在靴形喷油规律条件下,存在一个最佳的喷油提前角,使柴油机的动力性和经济性均达到最优。同时,随着喷油提前角的增大,柴油机缸内压力、缸内温度以及放热率均逐渐升高,且到达各自最大值的时刻前移,而NOx排放量和碳烟排放量则分别呈现出增加和减小的趋势。
