As empathetic as distant nations may feel about an ongoing or looming catastrophe in a particular region of Africa, they are too far removed from the horror to grasp its gravity and impact. Geographical proximity to the atrocity, and the likelihood of its spreading to their neighbourhoods, make the communities and neighbouring countries in the imploding region the best and most effective first responders to a crisis in their own backyard. A response from ‘communal’ or ‘regional’ groups is, therefore, the most practical measure for preventing human rights violations in Africa from descending into an actual genocide or an intractable genocidal condition. A community approach to preventing genocide and other human rights abuses should serve as the foundation for a new concept of ‘moral pan-Africanism’ on the African continent in the 21st century. This article makes an argument for this genocide prevention model and new moral concept.  相似文献

This paper examines the rationale and centrality of private military and security companies (PMSCs) in humanitarian assistance operations in Sudan, asking why PMSCs are involved in humanitarian assistance operations in Sudan and what the principles underlying their activities are. To answer this question, the paper draws attention to the link between humanitarian crises and PMSC interventions. Where there is no meaningful alternative intervention, undergirded by humanitarian concerns that are also profit driven, PMSCs come in to provide the needed services. The protracted and complicated internal armed conflicts in Sudan, which have lasted for over two decades, have produced as many as 4,8 million internally displaced persons (IDPs) – the single largest number in the world. The kind of humanitarian assistance operations provided by PMSCs in Sudan have become critical to the provision of much-needed services which were inadequately provided by governmental authorities at both unilateral and multilateral levels. This paper argues that the humanitarian crises in Sudan created a regime that permits humanitarian assistance operations by both state and non-state actors.  相似文献

This article examines the geopolitical dynamics associated with the African Union (AU) and United Nations hybrid operation in Darfur (UNAMID) from the start of the Darfur conflict in 2003 until the time when UNAMID became fully operational in 2011. It provides an overview of the complex forces and geopolitical dynamics that affected the deployment of UNAMID and shaped its unique hybrid character. It mainly highlights those primary geopolitical factors that hindered the full deployment of UNAMID. It is concluded that this period was a showcase for the newly established AU and its support for its member states, as well as a new approach for the international community to maintain international peace and security in alliance with regional organisations.  相似文献

In a environment where party financing, private funding in particular, is generally a laissez-faire business, as in most Southern African countries, there is the real risk that interest groups and wealthy individuals will buy influence in political parties and in so doing erode public confidence in the political system. Because they are neither open to public scrutiny nor subject to any legislative restraints, huge private donations can, and often do, come with strings attached. This lack of transparency and openness, as well as mechanisms to prevent it, provides ample ground for influence peddling, where those who pay the piper call the tune. Left unchecked, this party funding scenario will continue to be a serious indictment of the region's democratisation projects, crippling democracy and stunting economic development. Abstract

The signing of a new treaty on the equitable sharing of the Nile waters – signed last May in Kampala by Rwanda, Ethiopia, Uganda and Tanzania – has the potential of derailing relations with Sudan and Egypt. According to the latter countries, this new agreement replaces the 1959 Nile agreement – that awarded them with 90 per cent control over the Nile water – giving other Nile Basin countries the possibility to implement water-related projects in agriculture and energy. This new development, according to Egypt and Sudan, places their water level security in jeopardy. Furthermore, the use of land grabs and water consumption for food security by wealthy foreign countries contributes to the sensitive situation the nine Nile Basin countries are now facing. Water is a red line when it comes to Egypt and Sudan and the future of the whole region depends on whether this line will be crossed.  相似文献

In recent international armed conflicts private security contractors (PSCs) have played an ever increasing role and military advisors and tribunals are facing the dilemma of assessing the primary and secondary status of PSCs under international humanitarian law. In this article the misconception that PSCs are necessarily mercenaries will be dispelled. The possibility that PSCs might be categorised as combatants or civilians will then be explored. The conclusion is that where they are incorporated into the armed forces of a state, PSCs might attain combatant status. However, given that states are reluctant to formally incorporate PSCs into their armed forces, they will most likely remain essentially civilian. Their degree of participation in hostilities will determine whether they retain their immunity under international humanitarian law from attack and prosecution (as civilians) or whether they are rendered unlawful belligerents.  相似文献

ABSTRACT

The main purpose of this article is to analyze the philosophical problem of just and unjust memory. There is a general consensus about commemorating fallen soldiers and killed civilians. But, unfortunately, our human memory of such victims is often incomplete. Some victims are remembered, others are not – maybe very few even want to remember the latter. It turns out that in our world, not only wars may be just or unjust, but also the memory of their victims. In this context, a serious problem is the unequal memory of crimes perpetrated by Nazism and Communism in the last century, denying several dozen million victims of the latter totalitarian system their due place in the collective awareness of mankind. Therefore, one of the most important aspects of the ethical analysis of wars and totalitarian regimes should be the moral obligation to commemorate all victims in a just way.  相似文献
