| 摘 要： | 消防出警时存在着尽快赶赴现场与确保交通安全的义务冲突,如果因超速行车造成严重后果时,可以以义务冲突作为免责的理由,而不能对行为人以交通肇事罪论处。

| Abstract: | There exists a contradiction between the speed of arriving at fire spots and risking the danger of traffic accidents. Therefore, drivers of fire vehicles can be exempt from the punishment of traffic accidents caused by the fast speed because of the emergent mission. |
