火灾事故认定复核制度存在的问题及其完善

火灾事故认定复核制度既是当事人对火灾事故认定不服的法定救济方式,也是公安机关消防机构的内部监督途径之一。当前,法律法规对火灾事故复核制度在复核审查范围、审查方式及案件的最终处理方式的规定不尽合理,应当在复核程序中确立全面审查原则,实行书面审查方式与非书面审查方式并存,并进一步细化复核机构直接作出火灾事故复核认定和责令原认定机构重新作出火灾事故认定的适用条件。

The Problems with the Fire Accident Review System and the Improvement

Fire accident review system is not only the legal remedies against the parties identified in the fire accident,but also one of the internal supervision within fire control institutions of public security organs. At present,there exist some problems with the scope of the fire accident review system,with the way and the provisions of laws and regulations. The principle of the comprehensive review in the review procedures should be established,together with the implementation of the coexistence of a written review and non written one. The specific rules should be made for a direct fire accident review by the review organ and the suitable conditions of fire accident identification should be defined to order a review again by the original orgain.
