军事立法技术新解

军事立法技术是军事立法学和军事立法实践的基本要素之一，而军事立法技术的基本问题，则是军事立法技术研究的逻辑起点。从军事立法技术的概念、与一般立法技术的关系、运用的基本原则等方面，对军事立法技术进行简要分析。     

消防法中责令停止执业的法律依据

《消防法》规定的责令停止执业是对有法定消防行政违法行为的单位予以暂停相应资质、资格的一种处罚措施。其处罚主体为国家认证认可监督管理委员会以及地方质检部门;其处罚过程应适用听证程序,并确认、核实情节是否严重;其处罚实施应附有合理期限,同时需要采取相应保障措施。     

Capacity investment decisions under risk aversion

This article studies the optimal capacity investment problem for a risk‐averse decision maker. The capacity can be either purchased or salvaged, whereas both involve a fixed cost and a proportional cost/revenue. We incorporate risk preference and use a consumption model to capture the decision maker's risk sensitivity in a multiperiod capacity investment model. We show that, in each period, capacity and consumption decisions can be separately determined. In addition, we characterize the structure of the optimal capacity strategy. When the parameters are stationary, we present certain conditions under which the optimal capacity strategy could be easily characterized by a static two‐sided (s, S) policy, whereby, the capacity is determined only at the beginning of period one, and held constant during the entire planning horizon. It is purchased up to B when the initial capacity is below b, salvaged down to Σ when it is above σ, and remains constant otherwise. Numerical tests are presented to investigate the impact of demand volatility on the optimal capacity strategy. © 2016 Wiley Periodicals, Inc. Naval Research Logistics 63: 218–235, 2016     

Reforming China’s defense industry

ABSTRACT

Even with sizable economic inputs, access to foreign technologies, and considerable political will, China, up until the late 1990s, experienced only limited success when it came to the local design, development, and manufacture of advanced conventional weapons. Not surprisingly, therefore, reforming the local defense industry in order to upgrade its technology base and manufacturing capabilities and to make armaments production more efficient and cost-effective has long preoccupied the Chinese leadership. The fact that most of these efforts had little positive impact on the country’s military technological and industrial capabilities only encouraged Beijing to experiment with additional reforms in the hopes of finally getting it right.     

国际海洋法与维护国家海洋权益

海洋权益是指沿海国对属于自己的管辖海域享有国际海洋法所赋予的特定主权权利。《联合国海洋法公约》奠定了现代国际海洋法制度的基础，为各国维护正当的海洋权益提供了基本法律依据，但也有不完善甚至严重缺陷之处。认真研究其利弊，以切实维护国家海洋权益和公正合理的国际海洋法律秩序。     

螺旋轮式管道检测机器人越障性能研究

建立了一种螺旋轮式管道检测机器人驱动系统的三维模型，对驱动系统通过凸台和三通的能力进行了动力学分析。研究了预紧弹簧刚度和预紧力对螺旋轮过凸台能力的影响，讨论了过三通时的几何约束和动力学约束条件，并通过算例分析，验证了模型的正确性。     

论武警法学的建构

中国人民武装警察部队是我国武装力量的重要组成部分。武警理论研究、武警立法发展和武警执法实践都要求制定一部中国人民武装警察部队法。武警法是适用于武警部队的专门法,具有特殊性、专业性、独立性、分散性、交叉性的特点。武警法学具有自己独特的研究对象、研究方法、理论价值和科学体系,应该建构独立的武警法律学科,这是必然的发展趋势。     

一种结合弹道规律的模糊交互式多模型算法

针对交互式多模型算法中转移概率矩阵与实际运动不匹配而影响跟踪精度的问题,通过分析某型导弹的典型弹道,将弹道规律融合到模型概率转移矩阵中,然后将转移概率模糊化处理,提出了一种基于弹道规律的模糊交互式多模型算法,然后以导弹蛇形运动转至比例导引的机动过程为例进行了仿真验证,比较了典型交互式多模型算法和模糊交互式多模型算法的跟踪性能。仿真结果表明:该算法可显著提高导弹机动段的跟踪精度。     

Soldiers as victims: behind military barracks in the post-colonial African army

This paper examines the ways in which the military infringes on the social and political rights of soldiers who joined the Zimbabwe National Army in post-independence Zimbabwe. Contrary to the scholarly and policy debates that present Zimbabwean soldiers as the silent prop behind President Robert Mugabe and the perpetrators of political violence, this paper argues that these soldiers have also been victimised in army barracks. The victimhood of soldiers has been explicit in the ways in which they are forced to execute their duties beyond their professional expectations. In substantiating this argument, the paper explores the unethical military training and the ways in which soldiers are disciplined and punished through Chapter 11:02 of the draconian Defence Act. The paper’s contribution stems from a ‘rights’ perspective that emphasises the right to freedom, justice and protection, which is usually quite silent in the military. But the question is how can soldiers’ concerns be translated into new practices without compromising so-called ‘state security’?     

滑模控制的新型双幂次组合函数趋近律

提出一种基于双幂次组合函数趋近律的新型滑模控制方案。与现有的快速幂次或双幂次趋近律相比,具有更快的收敛速度,同时还保持了全局固定时间收敛特性,收敛时间上界与滑模初值无关。当系统存在有界扰动时,能够使滑模变量在有限时间内收敛到稳态误差界内,同时其稳态误差要小于现有方法的。仿真实验验证了该方法的有效性及理论分析的正确性。
